Welcome to Face Swap Video - AI Faceswap ("App", "Service", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Face Swap Video - AI Faceswap mobile application and related services.

The App is available on supported iOS and Android devices.

  • Save, download, and share AI-generated content.

  • Access premium features through subscriptions or one-time in-app purchases.

Certain AI features require photos or videos selected by the user to be temporarily uploaded to our secure servers for processing. The AI processing is performed through our own backend and AI processing infrastructure. Uploaded media is processed only to provide the AI service requested by the user and is handled in accordance with our Privacy Policy.

3. User Content

You retain ownership of all photos, videos, and other content that you upload to the App.

By uploading content, you represent and warrant that:

  • You own the content or have obtained all necessary rights, permissions, and licences to use it.

  • You have the necessary permission to use photographs or videos containing other people.

  • The content does not infringe any copyright, trademark, patent, privacy, publicity, or other legal rights.

  • The content complies with these Terms and all applicable laws.

  • The content does not contain malicious software or harmful code.

You are solely responsible for the content you upload and any consequences arising from its use.

4. Face Data and AI Processing

Certain AI features require processing photos or videos that may contain faces.

When you use an AI face-related feature, the App may process:

  • Photos containing faces.

  • Videos containing faces.

  • Facial information derived from the selected media when necessary to perform the requested transformation.

  • Other image or video information necessary to generate the requested result.

Commitments & Restrictions:

  • Face-related information is processed only to provide the AI feature requested by you.

  • When server-side processing is required, your selected photo or video may be securely transmitted from your device to our servers.

  • The AI processing is performed through our own backend and AI processing infrastructure.

  • We do not send uploaded face photos, videos, or facial information to third-party AI services for AI processing.

  • We do not sell, rent, or commercially trade uploaded face data.

  • We do not provide uploaded face data to advertisers or marketing companies.

  • We do not use uploaded face data for advertising or personalized advertising.

  • We do not maintain a permanent facial-recognition database of users.

  • We do not use uploaded face data to train general-purpose AI models, unless we obtain separate permission where required by applicable law.

5. Uploading and Temporary Processing

When you use an AI feature that requires server-side processing, the selected media may be uploaded to our servers.

Uploaded media is used only to:

  • Perform the requested AI processing.

  • Generate the requested image, video, or transformation.

  • Return the generated result to you.

  • Maintain the security and reliability of the processing service.

Retention: Uploaded AI media is automatically deleted from our servers within 3 days after processing.

If a feature processes media entirely on your device, your photos and videos remain on your device unless you choose a feature that requires server-side processing.

6. Acceptable Use

You agree not to use the App to:

  • Upload illegal, unlawful, or harmful content.

  • Upload content that infringes another person's intellectual property or privacy rights.

  • Upload malware, viruses, or malicious code.

  • Harass, threaten, abuse, or impersonate another person.

  • Generate deceptive, fraudulent, or misleading content intended to cause harm.

  • Use another person's face without appropriate authorization where authorization is required.

  • Generate sexually explicit or exploitative content.

  • Sexualize or exploit minors.

  • Use the App for unlawful, defamatory, fraudulent, or abusive purposes.

  • Attempt to gain unauthorized access to our systems or servers.

  • Reverse engineer, decompile, modify, copy, distribute, sell, lease, or create derivative works from the App except where expressly permitted by law.

  • Circumvent security or technical measures implemented by the App.

We reserve the right to suspend or permanently terminate access to users who violate these Terms.

7. Intellectual Property

The App, including its software, user interface, design, graphics, logos, trademarks, AI models, text, databases, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, and revocable licence to use the App solely for personal, lawful purposes. No ownership rights are transferred to you.

8. Third-Party Services

The App may use third-party services that provide functionality necessary for the operation of the App. These services may include:

  • Apple platform services

  • Google Play Services

  • Google Firebase Analytics

  • Google AdMob

  • Apple App Store services

  • Google Play Billing

  • RevenueCat

  • Meta Audience Network (where enabled)

  • Hosting, security, or infrastructure services required to operate our servers

These third-party services may process information according to their respective terms and privacy policies. Our AI face-swap processing is performed through our own backend and AI processing infrastructure and is not provided to third-party AI services.

9. Advertisements

The App may display advertisements provided by third-party advertising partners. Advertisements may be personalized based on your device settings, consent choices, region, and applicable law.

  • We do not control the content of advertisements displayed by third parties and are not responsible for products, services, or websites advertised through the App.

  • We do not provide uploaded face photos, videos, or facial information to advertising providers for advertising purposes.

10. Premium Features, In-App Purchases and Subscriptions

Certain features of the App may be available through paid subscriptions or one-time in-app purchases.

Depending on the platform:

  • iOS purchases are processed through Apple's App Store / in-app purchase system.

  • Android purchases are processed through Google Play Billing.

We do not collect or store your credit card, debit card, banking information, or complete payment details. Subscription management and purchase verification may be handled by RevenueCat.

Prices, subscription periods, products, and available purchase options may vary by country, platform, or applicable store policies. Subscriptions may automatically renew unless cancelled according to the applicable Apple App Store or Google Play subscription terms. You can manage or cancel subscriptions through the applicable platform account.

11. AI-Generated Content

AI-generated images and videos are created automatically using artificial intelligence. You acknowledge that:

  • AI-generated content may contain inaccuracies, unexpected results, or visual imperfections.

  • You are solely responsible for reviewing generated content before using, publishing, or sharing it.

  • We do not guarantee the accuracy, originality, legality, or suitability of AI-generated content for any specific purpose.

  • You are responsible for ensuring that your use of AI-generated content complies with applicable laws and the rights of others.

12. Availability of the Service

We strive to provide reliable access to the App; however, we do not guarantee that the App will always be available or operate without interruption.

We may, at any time and without prior notice:

  • Add, modify, or remove features.

  • Update or improve the App.

  • Perform maintenance.

  • Suspend or discontinue all or part of the Service.

13. Disclaimer

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including warranties relating to:

  • Accuracy of AI-generated content.

  • Availability or uninterrupted operation.

  • Fitness for a particular purpose.

  • Merchantability.

  • Non-infringement.

  • Compatibility with all devices.

We do not guarantee that the App will be error-free or free from harmful components. Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.

14. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages arising from:

  • Your use of the App.

  • AI-generated content.

  • Loss of data.

  • Device malfunction.

  • Business interruption.

  • Third-party services.

  • Unauthorized access to your account or device.

Our total aggregate liability for all claims arising out of or relating to the App shall not exceed the total amount paid by you, if any, for the App or applicable premium services during the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

15. Indemnification

You agree, to the extent permitted by applicable law, to indemnify, defend, and hold harmless us, our affiliates, employees, licensors, and partners from claims, liabilities, damages, losses, costs, or expenses arising from:
